Protecting debtors whose homestead is about to foreclosed upon is a passion of mine.
It astounds me how many home equity violations exist. Lenders were pushing loans when these types of loans were first approved in Texas. Many lenders didn't follow the rules. Appraisals were fabricated, interest rates were too high, closing costs exceeded the 3% cap and the list goes on and on.
The Texas constitution protects homeowners from these predatory practices TEXAS HAS ALWAYS BEEN PROTECTIVE WHEN IT COMES TO HOMESTEAD. This is the reason we were the last state to allow home equity loans. It is the reason Sam Houston moved to Texas.
Yet, I see lenders "getting away" with these violations on a daily basis. In Texas, you have to initiate the foreclosure proceeding by filing an expedited foreclosure proceeding in the district court to obtain permission from the court to then proceed with a non-judicial foreclosure. I see lenders obtaining default after default because homeowners don't know how to protect themselves. I also see lenders charging exorbitant and un-necessary fees for the foreclosure process - fees they are not entitled to receive.
